These Terms of Service ("Terms") govern your access to and use of the website https://gpt-image.hk and all associated services, features, and functionality offered by GPT-image2 (collectively, the "Service"). The Service and its original content, features, and functionality are and will remain the exclusive property of GPT-image2 and its licensors. The Service is protected by copyright, trademark, and other laws of both Hong Kong and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of GPT-image2. For images generated through the Service, users retain ownership of the content they create, subject to our rights to operate and improve the Service. Paid users receive full commercial usage rights for images they generate, while free users are granted a limited non-commercial license for personal use only.

3. User Conduct & Restrictions

• You agree not to use the Service for any purpose that is illegal or prohibited by these Terms.
• You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as explicitly permitted by us.
• You may not use the Service to generate content that infringes on third-party intellectual property rights, violates any applicable laws, or contains harmful, offensive, or illegal material.
• You may not attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, servers, or networks connected to the Service.
• You may not use the Service to send unsolicited communications, spam, or any form of automated requests.
• We reserve the right to terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

GPT-image2 MAKES NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

5. Limitation of Liability

IN NO EVENT SHALL GPT-image2, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE OF THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
